Definition
CommuteWork.com is a website operated by GemPrezz LLP (Singapore Business Registration No: T12LL1427A).
“Contract” means a contract between the Customer and GemPrezz LLP for the sale of Products evidenced by a Purchase Order accepted at website Commuter-Bike.com.
“Customer” means any person using the Services of Commuter-Bike.com.
“Products” means any goods or services advertised for sale at Commuter-Bike.com website
“Purchase Orders” means a Purchase Order in the form of an electronic record issued by the Customer via CommuteWork.com website or such other means recognized by GemPrezz LLP;
“Supplier” means, in respect of a Product, the original vendor or manufacturer from whom GemPrezz LLP may procure the Product for sale to the Customer;
The following sets out the terms and conditions under which GemPrezz LLP will offer its electronic commerce service known as “CommuteWork.com”. By using the Services as described below, Customers will be deemed to be bound by these terms and conditions.
Law and Jurisdiction
The laws of Singapore shall govern all contractual issues arising from the use of this site.
Prices
The prices at this website are in United States Dollars (US$).
Delivery charges will be calculated for each order transaction, based on customer’s ship-to address.
Customer is separately responsible for paying custom duties and taxes, if applicable, to ship products to desired ship-to address.
Price Errors
GemPrezz LLP endeavors to maintain accurate pricing information at its website. In the event that a pricing publication error is discovered, GemPrezz LLP shall be not be obliged to fulfill an order for a product that was published at an incorrect price. In such an event, GemPrezz LLP will email customer to cancel the order for the product and refund the amount paid by the Customer for the product.
Purchase Order and Order Acceptance
A Purchase Order from the Customer in respect of a Product or Products is irrevocable and cannot be cancelled without the agreement of GemPrezz LLP. Such a Purchase Order when accepted by GemPrezz LLP shall constitute a contract between the Customer and GemPrezz LLP.
All Purchase Orders are subject to information verification, product availability and GemPrezz LLP shall not be bound to accept any particular Purchase Order. No Contract shall come into existence until acceptance of the Purchase Order by GemPrezz LLP. GemPrezz LLP reserves the right not to accept any Purchase Order for any reason whatsoever.
When a Purchase Order is placed by the Customer for a Product, GemPrezz shall use its best endeavors to procure the Product from the relevant Supplier to ship to customer. In the event GemPrezz LLP is unable to procure the Product(s) from the Supplier or the Supplier fails to provide the Products to GemPrezz LLP for any reason whatsoever, including without limitation, due to a shortage of stocks, GemPrezz LLP shall inform Customer accordingly and refund the amount paid by the Customer for the Products either by cheque or, where payment by the Customer was originally via credit card or PayPal, to reverse or nullify such payment, and thereafter the Contract shall cease to have any effect and neither party shall have any claim against the other with respect to the Contract.
Delivery
Upon GemPrezz LLP’s acceptance of customer’s Purchase Order and successful customer payment for the products, GemPrezz LLP will arrange for the delivery of the products to customer’s ship-to address.
Goods sold and delivered are not returnable.
Risk of loss
Risk of loss or damage, and title to product, will pass to Customer and acceptance will occur upon delivery to the “ship to” address.
Product Quality
GemPrezz LLP will ship all products in saleable condition.
GemPrezz LLP shall not in any event be liable for damaged Product unless the Customer shall, within 14 days of receipt of the Products, write a notice of complaint email to enquiry@commutework.com
GemPrezz LLP may request for photos/inspection of the product and issue RMA (Return Authorization Number) if GemPrezz LLP accepts the return of the defective product.
Returns must be sent FREIGHT PREPAID by a recognized carrier with proof of delivery to return address specified by GemPrezz LLP. GemPrezz LLP will refund shipping cost only if the return is a result of GemPrezz LLP’s error, or for defective Products.
Upon receipt and verification of the defective product, GemPrezz LLP will either send customer a replacement product or refund the amount paid by the Customer for the Products either by cheque or, where payment by the Customer was originally via credit card or PayPal, to reverse or nullify such payment.
Product Warranties
GemPrezz LLP does not provide warranties for products or services sold at this website, www.Commuter-Bike.com.
Respective product manufacturers may provide warranties for their products, if applicable.
If manufacturer warranty is available, GemPrezz LLP may advise customer on the warranty claim procedures for applicable products.
Limitation of Liability
GemPrezz LLP AND ITS PARTNERS, RESELLERS, AFFILIATES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS), AS A RESULT OF USAGE OF PRODUCTS OR SERVICES SOLD AT THIS WEBSITE.
Indemnification
The customer agrees to indemnify and hold harmless GemPrezz LLP, its affiliates, employees, resellers and suppliers from and against all claims and expense, including indemnification of legal costs on a full indemnity basis arising out of the customer’s use of Commuter-Bike.com services. This indemnification also covers customer’s breach or alleged breach of any terms in this term of sale.

This website and its contents are provided on an ‘as is’ and ‘as available’ basis.
The contents of Commuter-Bike.com web site seek to provide customers sufficient information about its products and services so that customers can make an informed choice about whether or not to engage in the transaction.
While GemPrezz LLP will do our utmost to ensure accurate description of the products that it carries for sale, GemPrezz LLP does not warrant that the website or its products will meet all and any of customer’s requirements. In particular, GemPrezz LLP does not warrant that the website or products will always be available, accessible, secure, virus-free and error free.
Privacy Policy
GemPrezz LLP uses customer information to help complete a purchase order transaction, to communicate back to customer with updates on its products or services and to personalize CommuteWork.com web site for our customer’s experience. Credit card numbers are used only for payment processing, fraud protection and are not retained for other purposes.

GemPrezz LLP reserves the right to modify these Conditions from time to time. A Customer’s continued use of the Services after such modification has been published on Commuter-Bike.com Web Site shall be deemed as agreement by such Customer to be bound by these modified Conditions.
